How to submit copyright notices and counter-notifications to Ngroups.
Copyright notices
Ngroups.NET respects the rights of copyright holders. If you own a copyright, or are authorized to act for its owner, you can report material you believe infringes that copyright by emailing abuse@ngroups.net.
A notice must substantially comply with the Digital Millennium Copyright Act and include:
- Identification of the copyrighted work claimed to have been infringed, or a representative list if the notice covers multiple works.
- Identification of the material claimed to be infringing and enough information to locate it. Include the exact Usenet Message-ID for each article.
- Your contact information, including an email address and telephone number.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.
- Your physical or electronic signature.
We review substantially compliant notices. If your notice lacks the information needed to identify the material or establish the claim, we may be unable to act on it.
Counter-notifications
If you believe material was removed or disabled because of a mistake or misidentification, you may send a counter-notification to abuse@ngroups.net.
Include:
- The exact Message-IDs identifying the material that was removed or disabled, and where it appeared before removal.
- Your full name, address, telephone number, and email address.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled because of a mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal District Court in Las Vegas, Nevada, and will accept service of process from the original complainant or that person's agent.
- Your physical or electronic signature.
We forward a counter-notification to the original complainant, including your name and contact details. The complainant must notify us within ten business days if they have filed a court action seeking to restrain the allegedly infringing activity.
Accuracy and legal responsibility
Knowingly misrepresenting that material is infringing, or that material was removed by mistake or misidentification, can result in liability for damages, costs, and legal fees under Section 512(f) of the DMCA.
Consider obtaining legal advice before submitting a notice or counter-notification. More information is available from the U.S. Copyright Office.
Repeat infringement
In appropriate circumstances, Ngroups may disable or terminate the accounts of repeat infringers.
Personal information
Notices and counter-notifications contain personal information. Counter-notification details are shared with the original complainant as described above. Other disclosures are made where required or permitted by applicable law, including the DMCA. See our Privacy Policy for information about customer records.
